1. Overview
These Terms of Service govern your use of FW Totes LLC's rental services and website at fwtotes.com. By placing an order, you agree to these terms in full.
2. Rental Agreement
By completing a rental order, you enter into a binding rental agreement with FW Totes LLC. You agree to:
- Use all rented equipment for lawful moving and storage purposes only
- Return all items by the agreed pickup date and time
- Not sublet, lend, or transfer rented equipment to any third party
3. Delivery & Pickup
Delivery and pickup are available within our designated service zones. A responsible adult (18+) must be present at the time of delivery and pickup. If no one is available at the scheduled time, a redelivery fee of $50 may apply.
4. Condition of Equipment
All totes and equipment are inspected and cleaned before each rental. You are responsible for the equipment from the time of delivery until pickup is completed. Any damage, loss, or theft during the rental period is your financial responsibility.
The following conditions will result in additional charges:
Odors & Contamination
- Equipment returned with smoke, pet, food, chemical, or other persistent odors will be subject to a $25 commercial cleaning fee per affected item. If odor or contamination damage is deemed unusable, the full replacement cost of the item will be charged.
- Totes used to store or transport food, waste, chemicals, or hazardous materials are subject to the same cleaning and replacement fees.
Physical Damage
- Cracked or broken lids, handles, or latches will be charged at the replacement cost of the affected component or item.
- Stickers, tape residue, permanent marker, or graffiti on equipment will incur a $25 cleaning or restoration fee per item.
Pests
- Totes or equipment returned with evidence of bed bugs, insects, or other pests will be subject to professional pest remediation costs, which may include the full replacement cost of all affected items. FW Totes LLC reserves the right to charge the full replacement value of any equipment that cannot be safely remediated.
Misuse
- Equipment must not be used to transport hazardous, flammable, or illegal materials.
- Equipment must not be overloaded beyond its 75lb weight capacity.
- Rental equipment may not be transported or used outside the state of Indiana without prior written consent from FW Totes LLC.
5. Loss & Partial Returns
All items delivered must be returned at pickup. Missing totes, dollies, straps, or accessories will be charged at full replacement cost. Partial returns are not accepted — if items are stored in an inaccessible location at the time of pickup, a rescheduling fee of $50 will apply and pickup will be rescheduled.
6. Payment
Full payment is due at the time of booking. We accept all major credit cards through our secure checkout. By providing payment information, you authorize FW Totes LLC to charge the total rental amount including any applicable fees.
7. Cancellations & Refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which is incorporated into these terms by reference.
8. Limitation of Liability
To the fullest extent permitted by applicable law, FW Totes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our rental equipment or services. Our total liability for any claim — including direct damages — shall not exceed the total amount paid by you for the specific rental order giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
9. Governing Law
These terms are governed by the laws of the State of Indiana. Any disputes shall be resolved in the courts of Allen County, Indiana.
10. Changes to Terms
We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
